He and Mike Livingston persuaded Bill Abernathy to assist in breaking into the Archer house to plant drugs.^SK16 The three were arrrested by county Sheriff Steve Stoneslinger and his deputies.^SK15

It was later reported that Bill Abernathy was doing time for the breaking and entering, so it can be assumed that LaFayette and Livingston did too.^SK38
